Findings verified 2026-10-21 while researching low-budget (<=$30/person) background checks in the US.
- 'Legitimate business need' is narrower than it reads. 15 U.S.C. 1681b(a)(3)(F)(i) covers 'a business transaction that is initiated by the consumer', but the FTC staff report '40 Years of Experience with the FCRA' (2011, p.47) says it means a transaction 'primarily for personal, family, or household purposes' and 'does not cover business transactions that involve purely commercial purposes'. California's ICRAA (Civ. Code 1786.12) lists no business-transaction purpose at all. The clean basis outside employment is 1681b(a)(2), the consumer's written instructions (1786.12(c) in CA).
- Employer accounts are not a shortcut. Checkr/GoodHire $29.99 'Basic' requires a business account certifying a permissible purpose; certifying employment when it isn't one risks 1681q (obtaining a report under false pretenses). Certn's US product is business-only (its individual product is Canada-only). Accurate discontinued self-serve AccurateNow in Apr 2026.
- Self-check and share. Checkr Personal 'Checkr Pro' ($9.99/mo, 3-month minimum = $29.97) bundles an Essential self-check: ID+selfie verification, SSN trace, sex-offender registry, global watchlist, national criminal DB, unlimited county criminal across the SSN-trace address history; 3-7 business days. Bchex self-check: $29.95 (current county) / $39.95 (all counties in 7-year history), ~24h. The subject owns the report and chooses to share it, so the recipient never obtains a report from a CRA. Bchex and Checkr also sell 'check someone else' flows ($29.95 / from $49.99) where the subject receives an emailed consent invite.
- People-search sites are not substitutes. TruthFinder's terms bar use 'in connection with any business transaction'; Spokeo's terms are personal-use only. FTC fined TruthFinder/Instant Checkmate $5.8M in 2023, partly over inaccurate reports.
- A ~$30 consumer report is criminal-only. It misses SEC/FINRA/CFTC actions, civil suits, liens/judgments, education and employment claims. Fill with free sources: SEC EDGAR full-text (Form D related persons), BrokerCheck/IAPD, OFAC SDN CSVs (disambiguate common surnames by DOB/middle name), CourtListener RECAP (partial), PACER (fees waived if under $30/quarter), county court portals, plus reference calls. California-resident subjects' reports omit convictions older than 7 years (Civ. Code 1786.18); federal law has no limit on convictions.
Automation gotcha: Maryland Judiciary Case Search (403), Virginia OCIS (JS terms click-through), DC Superior eAccess and SF Superior (CAPTCHA), and VA SCC (reCAPTCHA) block scripted research; plan for a human-driven browser for state courts.
